Each session may have a specific agreement, scope, and deliverables outlined at the time of booking.

2. Booking and Payment

• A non-refundable retainer or deposit may be required to secure your date and time.

• Full payment is typically due prior to or on the day of service unless otherwise agreed upon in writing.

• Payment can be made via credit card, debit card, or approved digital services (e.g., Stripe, PayPal).

• Prices are subject to change but are locked in once a booking is confirmed.

3. Cancellations and Rescheduling

• Cancellations made less than 24 hours before the scheduled session may forfeit the deposit.

• Reschedules due to weather, emergencies, or illness can typically be accommodated with prior notice.

• Motion and Pixel Studios reserves the right to reschedule or cancel services due to unforeseen circumstances such as illness, equipment failure, or unsafe working conditions.

4. Client Responsibility

• Clients must arrive on time and ready for their session.

• You agree to communicate clearly about creative needs, usage rights, and any specific expectations.

• You warrant that you have the legal right to use all locations, props, wardrobe, or copyrighted material supplied by you.

5. Image and Video Delivery

• Digital files are typically delivered within [7-14 days] of the session date unless otherwise stated.

• Delivery is through a private gallery, download link, or secure client portal.

• Editing includes basic color correction and retouching unless otherwise specified. Advanced retouching or additional revisions may be subject to additional fees.

6. Copyright and Usage Rights

• All photographs and video content remain the intellectual property of Motion and Pixel Studios.

• Clients shall receive a non-exclusive, non-transferable license to use the final, delivered images for personal or commercial purposes (as outlined in the agreement).

• Unauthorized reproduction, resale, or manipulation of the media without written permission is prohibited.

7. Portfolio and Promotional Use

Unless otherwise agreed upon in writing:

• Motion and Pixel Studios reserves the right to use your photos or videos for promotional purposes, including portfolios, social media, website galleries, and advertising.

• Clients may request limited privacy or embargo periods upon request.

8. Limitation of Liability

• We will take every reasonable measure to ensure your satisfaction and protect your data.

• However, we are not liable for delays, loss of files due to force majeure, client misuse, technical failures, or third-party software issues.

• In any case, our total liability is limited to the amount you paid for the services.

9. Indemnification

You agree to indemnify and hold harmless Motion and Pixel Studios, its affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of our services or breach of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.
